为切实维护国际航行船舶在船船员身体健康，防止新冠肺炎疫情通过国际航行船舶船员跨境传播，依据《中华人民共和国国境卫生检疫法》《中华人民共和国突发事件应对法》《中华人民共和国海上交通安全法》等有关规定，现就有关事项公告如下：

一、本公告内容适用于所有拟来华的国际航行船舶。

二、本公告适用船舶在来华前一港口或地点和来华到港前14日内更换船员的，换班登船船员应在上船前3天内完成新冠肺炎核酸检测，并持新冠肺炎核酸检测阴性证明上船。检测应在中国驻外使领馆指定或认可的机构进行。

三、本公告适用船舶在办理抵华第一港入港手续时，应按要求通过船舶、其所属航运公司或其船舶代理机构提交来华前一港口或地点和来华到港前14日内新换班登船船员新冠肺炎核酸检测阴性证明的副本。

四、本公告适用船舶违反本公告要求和违反中华人民共和国相关法律法规规定的，将可能导致该船在华靠离港或作业受阻，情节严重的，将可能因此依法承担行政法律责任。来华前一港口或地点和来华到港前14日内新换班登船船员因不持有或持有虚假新冠肺炎核酸检测阴性证明来华，并在中华人民共和国境内引起新冠肺炎疫情传播或者有引起新冠肺炎疫情传播危险的，将可能因此依法承担刑事法律责任。

本公告自发布之日起施行。

Announcement by the Ministry of Transport, the General Administration of Customs and the Ministry of Foreign Affairs of People’s Republic of China on Epidemic Prevention and Control for Seafarers working on International trading ships.

Pursuant to the People’s Republic of China’s Frontier Health and Quarantine Law, the Law on Response to Emergencies and the Maritime Traffic Safety Law, this announcement is promulgated to effectively protect the wellbeing of seafarers on ships engaged in international trading and prevent cross-border spread of COVID-19 through ship’s crew. 

1. The content of this announcement is applicable to all international trading ships that intend to enter into Chinese ports. 

2. This Announcement applies to all applicable ships when seafarers’ changes take place at last port of call/location and within 14 days prior to ship’s arrival at Chinese port. All the signing on seafarers should take a nucleic acid test for COVID-19 within 3 days before embarkation and will be allowed to embark the ship only with a negative test result. The test should be performed in an institution designated or recognized by local Chinese Embassies and/or Consulates. 

3. All applicable ships, on arrival at first Chinese port and at the time when going through the port entry formalities, shall submit, either through the local agent or their owners, a copy (copies) of certificate(s) showing negative test result of nucleic acid test for COVID-19 for all crew members signed on at last port of call and within 14 days before arrival at Chinese port. 

4. Any violation of this announcement or any applicable laws and regulations of the People’s Republic of China by any applicable ships will result in blockage and hinderance of the subjective ships’ normal operation, entering or leaving Chinese ports, and in cases of gross violations, the relevant ships may be subject to administrative or legal liabilities. The crew members signed on ships at last port of call/location or within 14 days prior to arrival at China will be subject to criminal charges, if they failed to submit a negative nucleic acid test result for COVID-19 or have submitted a fake one, leading to the spread or having a risk of spread of COVID-19 in China, according to relevant Chinese laws. 

The announcement shall enter into force as of the date of promulgation.
